How To Find the Right Attorney
A family law attorney shares her advice on finding the right attorney.
Consulting an attorney is an excellent first step if you're getting a divorce. However, with so many attorneys out there, how do you find the right attorney for you? In Niki Miller's Family Law 101 training, she provides some guidance. Niki says you should look for these three things when selecting an attorney:
A Family Law Practitioner
Not all attorneys are the same. For example, a general practitioner who may handle your family's will or other matters is not necessarily equipped to handle your divorce. Instead, you should find an attorney whose sole practice is family law. This attorney is likely a member of your state's Family Law Bar Association. Your state's Bar's website will allow you to search for family law practitioners in your area.
The Right Fit
Establishing a strong rapport with your attorney is essential for a productive relationship. Open and honest communication is crucial, especially when discussing the assets in your estate. The more information you share with your attorney, the better they can advocate for you. If you ever feel unheard or uncomfortable, don't hesitate to seek a different attorney who understands and prioritizes your needs.
About 99% of cases will settle in mediation and thus will not require litigation. However, your attorney will represent you before the judge if mediation breaks down. For this reason, you need an experienced litigator who is well-versed in family law in your jurisdiction. Not all attorneys are skilled litigators. During your initial consult, don't be afraid to ask your attorney about their litigation experience and whether or not they have represented clients in your jurisdiction. A litigator is a must-have if you know that your divorce will be contentious and there are many assets.
